1. Agreement to Terms

By accessing and using PartySpark Events services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services. 2. Service Description

PartySpark Events provides professional party planning, event coordination, custom decoration services, and entertainment arrangement services throughout Australia. Our services include consultation, planning, vendor coordination, decoration design and installation, entertainment booking, timeline management, and on-site event supervision.

We strive to deliver high-quality celebration experiences tailored to client preferences and requirements. However, the specific scope of services will be defined in individual service agreements or contracts established with each client. Service availability may vary by location and season.

3. Client Responsibilities

Clients engaging PartySpark Events services agree to provide accurate information regarding event requirements, preferences, guest counts, venue details, and any special considerations. Clients are responsible for reviewing and approving all plans, decoration concepts, and vendor selections in a timely manner to ensure successful event execution.

Clients must comply with all venue regulations, obtain necessary permits or licenses for their events, and ensure that all activities comply with local laws and regulations. Any changes to event plans should be communicated promptly to allow adequate time for adjustments and coordination.

4. Booking and Consultation

Initial consultations are provided to discuss event requirements, explore service options, and determine suitability for our planning services. Formal booking of services requires completion of a service agreement that outlines scope, deliverables, timelines, and responsibilities of both parties.

Availability of services is subject to our planning team's schedule and capacity. We recommend booking services well in advance, particularly for peak celebration seasons and large-scale events requiring extensive coordination.

5. Cancellation and Modifications

Cancellation policies and procedures are detailed in individual service agreements. Clients wishing to cancel or significantly modify booked services should notify PartySpark Events as early as possible. The terms regarding cancellations, postponements, and modifications will be specified in the service contract.

PartySpark Events reserves the right to cancel or reschedule services in cases of force majeure, severe weather conditions, venue unavailability, or other circumstances beyond reasonable control. In such cases, we will work with clients to find suitable alternatives or solutions.

6. Vendor Coordination

PartySpark Events coordinates with third-party vendors including caterers, entertainers, florists, rental companies, and other service providers on behalf of clients. While we carefully select and manage vendor relationships, we are not liable for the performance, quality, or conduct of independent third-party vendors.

Clients have the option to approve or decline vendor selections. Any direct agreements or contracts between clients and vendors are separate from our service agreement, and clients should review vendor terms independently.

7. Limitation of Liability

PartySpark Events and its team members shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services or inability to use services. Our liability is limited to the direct damages proven to be caused by our negligence or breach of contract.

We are not responsible for injuries, accidents, property damage, or losses occurring during events, except where directly caused by our proven negligence. Clients are encouraged to obtain appropriate event insurance to protect against unforeseen circumstances.

8. Intellectual Property

All content, designs, concepts, materials, and intellectual property created by PartySpark Events remain our property unless specifically transferred through written agreement. Clients may not reproduce, distribute, or commercially exploit our proprietary decoration designs, planning methodologies, or creative concepts without permission.

Clients retain ownership of any materials, content, or information they provide to us. We may use photographs, testimonials, and event descriptions for marketing purposes unless clients explicitly opt out of such usage in writing.

9. Privacy and Data Protection

Collection, use, and protection of personal information are governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. We are committed to protecting client privacy and handling personal data in accordance with applicable Australian privacy legislation.

Clients consent to our collection and use of information necessary to provide services, including communication details, event preferences, and related information. We do not sell or share client information with third parties except as necessary to deliver services or as required by law.

10. Professional Conduct

PartySpark Events maintains professional standards in all client interactions, planning activities, and event execution. We expect clients and their guests to treat our team members and vendors with respect and courtesy. We reserve the right to withdraw services in cases of abusive behavior, harassment, or unreasonable conduct.

Our team adheres to ethical business practices and complies with all applicable professional regulations and industry standards for event planning and coordination services throughout Australia.

11. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, extreme weather events, government restrictions, public health emergencies, civil unrest, or other force majeure events. In such circumstances, we will work collaboratively with clients to find reasonable solutions.

If force majeure events make event execution impossible or unsafe, both parties agree to discuss alternatives including postponement, modification, or cancellation with fair consideration of circumstances and expenses already incurred.

12. Dispute Resolution

Any disputes arising from these Terms of Service or from services provided by PartySpark Events shall first be addressed through good faith negotiation between parties. If resolution cannot be reached through discussion, disputes shall be submitted to mediation before pursuing legal action.

These terms are governed by the laws of Australia, and any legal proceedings shall be conducted in the appropriate jurisdiction based on the location of service delivery or our business operations.

13. Website Use
